The National Institute of Advanced Industrial Science and Technology (hereinafter referred to as “AIST”) hereby grants a license to use this software, provided that End User (End User means either an individual or an organization which the individual belongs to; hereinafter referred to as “User”) carefully reads the following terms and conditions of this agreement and agrees to be bound by all of its provisions.<\/p>\n

Software License Terms and Conditions<\/p>\n

Description of Software Manager, Software Name, and Serial Number<\/h2>\n

Paragraph 1: With respect to the software, AIST designates “Bin-Le Lin” as its manager, “National Institute of Advanced Industrial Science and Technology – Multi-purpose Ecological Risk Assessment and Management Tool (AIST-MeRAM)” as its name, and “H28PRO-2007” as its serial number. User shall, when using the software, indicate AIST\u2019s copyrights along with such manager, name, and serial number.<\/p>\n

Copyrights<\/h2>\n

Paragraph 2\u3000Paragraph 2: Copyrights of programs, documentation, etc. pertaining to the software, are owned by AIST. User shall comply with applicable copyright laws, international treaties, etc. concerning copyrights.<\/p>\n

Paragraph 3: AIST prohibits User from reverse engineering, decompiling, disassembling, or otherwise modifying the software in any manner whatsoever.<\/p>\n

Paragraph 4: AIST prohibits User from using any programs, data, etc. contained in the software for any purpose other than using the software.<\/p>\n

Paragraph 5: In the event that User publishes results derived by using the software at academic conferences or in journals, User shall indicate the following citation in Japanese or English in such publications, and shall send a copy of such publication to AIST.<\/p>\n

Examples of citation:<\/p>\n

“AIST-MeRAM Ver. X (revise the X as the version you used), which was developed by the National Institute of Advanced Industrial Science and Technology under the LRI (Long-range Research Initiative) program of Japan Chemical Industry Associations, was utilized for this risk assessment\/ management.”<\/p>\n

Limitation of Liability<\/h2>\n

Paragraph 6: The software, its related documents, etc. areprovided “AS IS.” AIST shall have no obligation to provideupgrades or correct any errors.<\/p>\n

Paragraph 7: AIST reserves the right to change thespecifications of the software and\/or documentation for thepurpose of improvement without prior notice to User.<\/p>\n

Paragraph 8: AIST makes no warranty of evaluation andconsistency of assessment results obtained by User\u2019scalculations using the software, documents, etc., regardlessof whether or not the use of the software is expressly cited.In addition, AIST is not obliged to answer any inquiriesregarding the content of the software.<\/p>\n

Paragraph 9: In no event shall AIST be liable for any damagearising out of the use or inability to use the software ordata contained in the software.<\/p>\n

Restriction on Distribution of Software<\/h2>\n

Paragraph 10: In principle, no person, corporation,association, etc. may distribute the software itself or alongwith any other product for profit; provided, however, thatwhen, with the consent of AIST, User produces or sells thesoftware, or provides services such as technical training andsupport of the software, User shall enter into a separateagreement with AIST to carry out such operations.<\/p>\n

Consent to Jurisdiction<\/h2>\n

Paragraph 11: AIST and User consent to the exclusivejurisdiction of the Tokyo District Court over any disputearising out of this Agreement.<\/p>\n

Paragraph 12: User is requested to send copies of publicationsas well as any information concerning program bugs to theaddress set forth below. Please note that, in principle, AISTwill not respond to individual inquiries from User. Only lettersor e-mails are accepted. No telephone inquiries are accepted.<\/p>\n
